These General Terms and Conditions shall be applied upon sale of Cappelen Dimyr products and constitute an integrated part of a contract between Cappelen Dimyr and the partner.

Prices

All prices are listed as catalogue price and RRP. Your purchase price is the price you pay for each product after the discount is deducted from our catalogue price. We have specific prices for different markets and we ask all partners to follow the RRP for the specific market listed in your trade account. We have the right to change prices due to changes in exchange rates, taxes, fees, or customs duties. For EU orders every partner needs to supply a valid VAT number in order to be charged without Swedish VAT. All partners outside EU will be charged without Swedish VAT.

All prices are quoted DAP (”Delivered At Place”) and include the costs of such packing materials that may be deemed necessary under normal transport conditions. Delivery and shipping costs will be added and quoted individually, read more in “shipping and delivery”. For countries outside EU, local import duties, customs, tariffs and/or VAT/tax fees may be applied by your country's customs authorities. Please check your local import regulations for exact fees. Normally, this will be invoiced separately by the shipping partner or customs.

Payment and Order Processing

All orders must be pre-paid in full before production or shipment begins. We will not manufacture or dispatch any goods until the corresponding payment has been received and confirmed. Customers may choose to pay in their local currency by credit or debit card, or via invoice in EUR. Please note that any delays in payment will directly affect the production and delivery timeline of your order. All invoices must be paid within fifteen (15) days of issuance.

Shipping & delivery

Delivery and time frames will be determined upon order confirmation. All dates are preliminary and refers to when the order is dispatched, not delivered at the delivered place. Delivery is sent by DAP (”Delivered At Place”), as set forth in the most recent edition of INCOTERMS. Delivery and shipping costs will be added and quoted individually and specified on all quotes, orders and invoices. For countries outside EU, local import duties, customs, tariffs and/or VAT/tax fees may be applied by your country's customs authorities. Please check your local import regulations for exact fees. Normally, this will be invoiced separately by the shipping partner or customs.We offer drop shipment with a direct shipment to your client’s address. All drop shipments are sent DDP (Delivered duty paid) - Taxes and duties are included, no extra fees at delivery.The cost for drop shipment is calculated for each request or order, the price is set by the address and destination which you specify in the request sent to us. Use the drop shipment option at checkout to add this service for any order.

Custom Orders

Custom orders are available and can be calculated and requested through the Products page. All custom orders are non-refundable and the full amount must be pre-paid before manufacturing commences. All custom orders will be shipped under incoterms DDP. We ship all custom orders directly from India in order to offer cost efficient shipping. 

Sales and online sales

You are only authorised to sell via your business as stated on your initial request. Cappelen Dimyr rugs shall be sold at the recommended retail price. You are forbidden from selling Cappelen Dimyr rugs on any other online retail outlet. Even if your retail store has online sales attached you must receive separate approval for both outlets. As a partner you are required to use the product names and descriptions as provided by Cappelen Dimyr. Each product must also be named with the brand i.e Cappelen Dimyr no.xx

We do not allow our rugs to be sold at online auction sites or through markets without written permission. Examples of this may be Amazon, Ebay, Facebook Marketplace etc.

If you do not place a re-order within 6 months we will re-evaluate the partnership.

Claims and returns

Please inspect all shipments immediately upon arrival. Please do not return rugs before contacting us. For cancellations and order changes, they must be reported by email within 10 days of order. For defect rugs they shall be reported by email. No general returns on orders will be accepted unless in the event of a defect.

Cappelen Dimyr rugs may vary in colour and/or detailing because of the handcrafted nature of the item. This makes every piece unique. You accept this when the order is placed. It will not be a considered defect and therefore no claim for a refund.

We also reserves the right to make minor changes to the product if required for technical manufacturing reasons or consequent upon the producer having modified the design of the product.

Design Rights and Protection

All the designs are owned by Cappelen Dimyr and protected internationally via the Hague System for the International Registration of Industrial Designs provided by WIPO (World Intellectual Property Organization). If we find our designs being plagiarized or copied, we will take legal matters accordingly.

Copyright and Images

This website is owned by Cappelen Dimyr, and subject to copyright. If you would like to use any of our images for promotional purposes, please ask for permission first - a simple email is fine.

Force majeure

If a party, or a subcontractor to a party, is prevented from performing as a consequence of an event beyond its control (including but not limited to strike, fire, flood, extreme weather, natural disaster, war, uprising, invasion, vandalism, sabotage, riot, terrorism embargo, scarcity of means of transport, general scarcity of goods, or new legislation) and which event could not reasonably have been foreseen, the party shall be released from liability to perform the contract.
